List of witnesses had to be presented in the court not later than seven days after framing of issues --- Law favoured adjudication on merits and not mere technicalities but also favoured the vigilant and not the indolent and he whoever slept over his rights had to suffer the consequences --- Ground raised by the petitioner was not sufficient or good ground for condoning the delay in filing the list of witnesses --- Courts below had rightly dismissed the application --- Constitutional petition was dismissed
